1.Sales Contract
1.1 Orders placed by you on the website https://blacklockjewellery.com (the "Website") for the Products offered by us through the website are only an offer to conclude a sales contract. The sales contract is entered into upon the confirmation of the order by e-mail by us to you.
1.2 You are the individual or individuals placing the order ('you', 'your'). You must be 18 years or over to enter into a contract with us by placing an order with us, you confirm that you are 18 years or over. We supply products for domestic and private use.
1.3 This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither party will need to get the agreement of any other person to end the contract or make any changes to these terms.
1.4 We intend to rely upon these purchase terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by ourselves, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
2. Order Placement
2.1 Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please carefully check your order at each page of the order process.
2.2 After you have placed an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in clause 3.3.
2.3 We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched ("Dispatch Confirmation"). The Contract between us will only be formed when we send you the Dispatch Confirmation.
2.4 If a Product is not in stock and we are unable to supply you that Product or because we cannot verify delivery or payment information you have supplied, or because we have identified an error in the price or description of the Product(s) or because we are unable to meet a delivery deadline you have specified we will inform you of this by email and we will not process your order. If you have already paid for the item(s), we will refund you the full amount (including any delivery costs).
2.5 If we are unable to verify the delivery or payment information you have supplied, we may restrict delivery to the address to which your credit or debit card is registered.
3. Data Protection
3.1 To provide you with the product(s) on our website and to process your orders, we may collect and process personal information that you provide us when placing an order and purchasing product(s) from our website. For information on how we use and process your personal information please see our Privacy Policy
4.Payment
4.1 We accept all major credit cards (American Express / MasterCard / Visa) debit cards (Solo / Maestro / Visa Debit / Visa Delta / Visa Electron), MOTO payments, cheques and BACS transfers for payment.
4.2 Your credit card or other account detailed at 4.1 above (other than cheques) will be debited when you click on the "confirm" button.
4.3 You must pay for products before we dispatch them. We will not charge your credit, debit or charge card until we dispatch the item(s) to you. Please see clause 13 for payment terms for Bespoke Orders.
4.4 In the event that the sum due cannot be debited for whatever reason, the sale will be cancelled and you will be notified in writing.
4.5 If you wish to arrange for delivery or collection of Jewellery in a country other than your country of origin, you will need to contact us directly by phone or in person to make the order and arrange payment and delivery.
4.6 Any credit card used for payment must be in the name of the person ordering and the same card must be carried at the time of delivery - it may be required for verification and obtaining signature on a credit card charge form for delivery.
4.7 If you are paying by bank transfer, we will send you BACS details by email and will confirm receipt of payment with you once your funds have arrived in our bank account.
4.8 Whenever making a BACS transfer you are required to quote your surname as reference. Without the surname reference we are unable to identify your payment.
4.9 We do not accept payments by cheque.
5. Pricing and VAT
5.1 All prices stated on this website include and are subject to the current rate of UK VAT at the then prevailing rate. However, if the rate of VAT changes between the date of your order and the date of delivery, where applicable, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.
5.2 VAT is charged on all orders including international orders.
5.3 All International orders are manually input to ensure the correct tax charges for your location.
5.4 It is the responsibility of you, the customer to provide the requisite evidence and information to be able to claim back VAT and prove that your order is Zero rated, if applicable. Once the full required evidence and information is received and verified by Blacklock Jewellery you will be credited back the VAT that you have been charged. You will receive the rebate in the form that the payment was received.
5.5 Our site contains a large number of Products, and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures. If we accept and process your order where a pricing error is obvious and unmistakeable and could have reasonably been recognised by the average customer as an error, we may end the Contract, refund you any sums you have paid and require return of any products provided to you.
5.6 Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
5.7 Each piece of jewellery sold is priced according to current industry prices / indexes. Each Bespoke Order is priced in relation to the time spent on design, weight of gold or platinum employed, the cost of diamonds and/or gemstones, hallmarking, additional fittings and setting and finishing. Prices are updated monthly.
6. Purchase of Products and Services
6.1 Product Listings, Specifications and Measurements
6.1.1 The Product(s) may vary slightly from their pictures. The images of the Product(s) on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the Product(s). Your Product(s) may vary slightly from those images.
6.1.2 Although we have made every effort to be as accurate as possible, the Product(s) sizes, colours, dimensions and measurements indicated on our website may not be precise. If you have any doubts about the colour, size of any specification of the Product(s) you wish to order, please contact us prior to placing your order on our website.
6.1.3 Making sure your measurements and information are accurate: if we make any Product(s) to measurements you have given us or are providing engraving services, you are responsible for ensuring that measurement and engraving instructions are correct.
6.2 Product Listings and Prices
6.2.1 We offer products for direct sale through our website up to the value of £15,000. We do offer Products for sale of value higher than £15,000, however purchase can be made via direct contact / direct sale.
6.2.2 Prices are as stated on the website and are subject to change. We will inform you of any changes in pricing before completing your order.
6.2.3 We do maintain a controlled amount of ‘Stock’ Products, but whilst we do our very best to ensure that there is an accurate inventory for your shopping ease, items do sell out. This usually happens when two or more customers order the same item at the same time, before our website has been updated. If this happens you will be notified in a timely manner (usually the same or next day), and we will offer you suggestions on fulfilment of your order or refund any monies paid by you.
6.2.4 Products held in stock will be delivered within 3 - 5 working days subject to the correct sizing requirements.
6.2.5 Products out of stock will be delivered within 10-15 working days.
6.3 Made-to-Order Products
6.3.1 We offer 'Made-to-Order' products, which require a processing time of up to 12 weeks from the date of order. If we need to source gemstones or materials for your made-to-order product, we will inform you of any notable changes in specification compared to what has been provided online.
6.4 Guide Price Products
6.4.1 Some products are listed on the website with a 'Guide Price.’ These products feature specialist diamonds, gemstones, and precious metals that necessitate careful sourcing and final price confirmation by our team. To facilitate this process, please submit your details through our enquiry form. We will respond promptly once we have gathered the necessary information.
6.5 One-Of-A-Kind Products
6.5.1 Some products are listed on the websire as 'One-Of-A-Kind'. These products feature specialist diamonds, gemstones, and precious metals that necessitate careful sourcing and final price confirmation by our team. To facilitate this process, please submit your details through our enquiry form. We will respond promptly once we have gathered the necessary information.
6.6 Limited Edition Products
6.6.1 Limited Edition products are available for purchase in a finite number. Once these products are sold out, they will not be available again in the exact same configuration. We reserve the right to change the configuration and offer as a new product in the future.
6.6.2 For certain specific promotional limited editions we have created a form which will allow you to be informed of the status of the limited edition. Please complete this form and submit if you wish to be kept informed about limited edition status and future releases.
6.7 Limited Production Products
6.7.1 Limited Production products are available for purchase within a set timeframe, regardless of the number of items produced. You may place an order within this set timeframe and receive the product even after the timeframe has ended.
6.7.2 For certain specific promotional limited productions we have created a form which will allow you to be informed of the status of the limited production. Please complete this form and submit if you wish to be kept informed about limited production status and future releases.
6.8 Bespoke Jewellery
Blacklock Jewellery also offers a Bespoke commission service ('Bespoke Jewellery') where Clients work exclusively with our design team to create bespoke fine jewellery items.
6.8.1 General
6.8.1.1 The creation of Bespoke Orders will be undertaken in full confidence and discretion of the person ordering the commission. From time to time, we may request that the design is recreated for further sales and marketing purposes – this will be undertaken in full knowledge of the person that has placed the order.
6.8.1.2 The design and all rights associated with it are still owned by Blacklock Jewellery, however files of all the final designs associated with the piece created are passed over to the individual that has commissioned the design once full payment is received. At all points until this moment the files are owned by Blacklock Jewellery. If these files are shared by the person requesting the commission with a competitor (within the bespoke jewellery / jewellery sector) we will look to act.
6.8.1.3 We do not allow the individual who has commissioned the piece to market / sell the product as their own.
6.8.1.4 An estimate of the cost of undertaking the Bespoke Order will be given at any stage that the client requests. The estimate approximates the cost of the job being undertaken and is based upon similar previous jobs and the cost of the precious metals, diamonds and gemstones being used.
6.8.1.5 We will not be held to this price as the confirmed finished price. A quotation will be issued when the finished design is approved. We will however hold this price for seven days from the date that the quotation is issued due to the fluctuation of prices of precious metals, diamonds and gemstones.
6.8.1.6 Bespoke Orders require a 50% deposit on approval of the design and confirmation of the order. The remaining 50% is paid upon delivery.
6.8.1.7 All Bespoke Orders are payable by BACS transfer, details of which will be confirmed at point of Order confirmation.
6.8.1.8 Production and delivery timescale of Bespoke Orders are dependent on complexity of the piece commissioned. We estimate an average time frame of 5-7 weeks from start to delivered item received.
6.8.2 Estimates, Quotations and Order Processing
6.8.2.1 Estimates are approximate calculations for the cost of undertaking an order. At no stage is Blacklock Jewellery liable to uphold an estimate.
6.8.2.2 A quotation from Blacklock Jewellery formalises a previous estimate which confirms the current market price for your order. Once a quotation is received you are required to confirm in writing via email or letter that the quotation is approved before production can proceed. We will only commence work once we have received this as written confirmation.
6.8.2.3 Quotations that are provided by us are valid for one month only; after this time, we will re-quote since the price of jewellery-based commodities (such as diamonds, gemstones and precious metals) is liable to change.
6.8.2.4 We determine in our sole discretion whether to proceed or not with any Bespoke Order.
6.8.2.5 Should the order not be accepted by us, Blacklock Jewellery will return the loose gemstones, diamonds or jewellery by the same method of delivery receipt free of charge.
6.9 Refresh and Reset Service
6.9.1 Blacklock Jewellery also offers a Refresh and Reset service whereby old, treasured pieces of jewellery are redesigned using the original component parts (gemstones or diamonds). The key component parts are then made into a new piece of jewellery. We reserve the right to not accept and proceed with this service upon inspection of the original item presented to us by the Client.
6.9.2 Blacklock Jewellery will return the loose gemstones, diamonds or jewellery by the same method of delivery receipt free of charge.
6.9.3 The Client accepts the liability when they enter into agreeing to proceed with such a service and do not hold Blacklock Jewellery liable in relation to the state of the gemstones, diamonds or jewellery upon inspection.
6.9.4 The Client accepts that once this service commences then the original piece of jewellery cannot be supplied back in its original form – Blacklock jewellery has no liability in this instance.
7. Shipping / Delivery
7.1 Delivery of all Products and Services
7.1.1 All products delivered by us remain our property of until such time as you have paid for them in full, including damages, costs and interest, in the event of late or delayed payment.
7.1.2 You have no right to retain any jewellery that has not been paid for in full in accordance with 4. Payment
7.2 UK Delivery
7.2.1 All Products and Bespoke orders are delivered free of charge in the UK. Dependent on value we deliver by our expert courier or by Royal Mail Special Delivery Next Day. These items are fully insured.
7.2.2 Deliveries are not made to PO Box or hotel addresses in the UK.
7.2.3 The Product will be your responsibility from the time we deliver the product to the delivery address you gave us or from the time you collect it from us.
7.2.4 You own the goods once we deliver the Product to the delivery address you gave us or from the time you collect it from us.
7.2.5 UK delivery covers England, Scotland, Northern Ireland, Wales, the Channel Islands, Scilly isles and the Shetlands.
7.3 Personal Hand-Over (London and Northeast only)
7.3.1 For items over the value of £2,000 we endeavour to deliver personally – we will try to deliver an item by a certain time on a specific date.
7.3.2 Once we have informed you that your item(s) are ready. Please contact us directly to discuss and confirm details.
7.3.3 When collecting your order using the Personal Hand-Over service please ensure you bring along identification and Dispatch Confirmation (proof of payment) from when order was confirmed.
7.4 International Delivery
7.4.1 We use an expert courier for all international orders. These items are fully insured.
7.4.2 For any international deliveries please contact us directly to discuss your specific delivery requirements.
Please note deliveries are not made to PO Box or hotel addresses outside of the UK.
7.4.3 The Product will be your responsibility from the time we deliver the Product to the delivery address you gave us or from the time you collect it from us.
7.4.4 You own the goods once we deliver the Product to the delivery address you gave us or from the time you collect it from us.
7.4.5 At the end of the Order process, we will confirm via telephone or email when your item(s) will be delivered
7.4.6 We are not responsible for any delay or prevention of delivery of your item(s). We will inform you as soon as possible and advise on relevant steps being taken to correct situation
7.4.7 At this time, we are unable to offer the specific time or 'Personal Hand-Over' delivery services for international orders.
7.4.8 Blacklock Jewellery is not liable for any damage or loss of items of jewellery or loose stone(s) after courier has accepted item for delivery.
7.4.9 Any claim must be made directly to the carrier.
7.4.10 International delivery covers the following countries;EUROPE: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Gibraltar, Greece, Guernsey, Hungary, Ireland, Italy, Jersey, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland NORTH AMERICA AND FAR EAST: USA, Canada, Hong Kong, Japan, Malaysia, Singapore, Thailand.REST OF THE WORLD: Australia, Bahrain, India, New Zealand, Qatar, Saudi Arabia, UAE.
8. Warranty
8.1 If any jewellery you purchase from us ("Jewellery") is found to have a defect in material or workmanship within 12 months of the date of purchase, we will repair that defect without charging you for materials or labour.
8.2 If the Jewellery cannot be repaired, then we will replace the Jewellery with an identical or what we consider to be a near identical piece.
8.3 This warranty is valid only to the original purchaser when a new piece is purchased from us.
8.4 This warranty is invalidated if you allow a third party to repair or attempt to repair any Jewellery.
8.5 In the event of a dispute as to the cause of damage, we reserve the right to send the Jewellery to a mutually agreed independent third-party assessor to determine the nature of the defect. Only if their judgement indicates a defect in material or workmanship will we repair the Jewellery.
8.6 This warranty does not cover expenses incurred by you due to a lack of proper care of your Jewellery. Please see 'Caring for Fine Jewellery' for guidance.
8.7 Please keep your proof of purchase documents – they will be required for to procure warranty service in the event you wish to make a warranty claim.
8.8 Please notify Blacklock Jewellery within 14 days of purchase if you wish to claim a replacement for a defect.
9. Loss and Damage
9.1 We are responsible to you for foreseeable loss and damage caused by us: If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking the contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
9.2 We will repair or replace, free of charge (including costs of re-delivery) any Products which are damaged or lost in transit where delivery is made by our carrier, but only if:
- 9.2.1 you tell us about the damage or loss within 24 hours of the delivery date in the case of damage and within 24 hours of the delivery date we gave you when you placed your order in the case of loss; and
- 9.2.2 you produce to us all documents relating to the lost or damaged Products and the original packaging for damaged Products
10. Import Duties and taxes
10.1 Delivery outside European Union
10.1.1 For delivery outside of the European Union, you may be subject to import duties and taxes which are levied once the package reaches the destination country when ordering goods from Blacklock Jewellery. Blacklock Jewellery has no control over these charges and cannot predict what they may be. Blacklock Jewellery is not liable to pay any additional charges for customs clearance in relation to goods entering into a foreign country. Any additional charges for customs clearance must be borne by you.
10.1.2 It is your responsibility to contact your local customs office to understand the relevant Customs policy for the country where the goods are being received.
10.1.3 When ordering from Blacklock Jewellery, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.
11. Limitation of Liability
11.1 As a condition of use of this Website, you agree to indemnify us from and against all liabilities, expenses (including legal fees) and damages arising out of claims resulting from your use of this Website, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions.
11.2 Subject to the following sub clauses, in no event shall the aggregate liability of any party to the other (whether it contract, tort (including negligence) or otherwise) and in respect of all claims, losses and damages arising under or in connection with these Terms and Conditions:
- 11.2.1 Provided that this shall be subject to an overall limit of the total amount paid to Blacklock Jewellery under a confirmed order in respect of any and all claims, losses and damages arising under or in connection with these terms and conditions.
- 11.2.2 The above limits on liability shall apply in respect of (any indemnities provided by either party under this Agreement, including without limitation to the indemnities under clauses 13.1 Intellectual Property in Website Terms of Use)
- 11.2.3 Each party's liability to the other in contract, tort (including negligence), misrepresentation (whether innocent or negligent), breach of statutory duty or otherwise arising out of or in connection with these terms and conditions shall not extend to any:
a) loss of profits.
b) loss of business opportunity.
c) loss of goodwill.
d) loss of data.
e) loss of anticipated savings; or
f) any special, indirect or consequential loss or damage whatsoever.
- 11.2.4 The parties agree that the limitations on liability within these terms and conditions are reasonable given their respective commercial positions and ability to purchase relevant insurance in respect of risks.
- 11.2.5 We only supply the Product(s) for domestic and private use. If you use the Product(s) for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- 11.2.6 Notwithstanding the above or other limitations and exclusions of liability set out in these terms and conditions, neither party excludes or limits any liability for:
a) personal injury (including sickness and death) to the extent that such injury results from the negligence or wilful default of a party or its employees; or
b) fraud or fraudulent misrepresentation; or
c) any breach of any obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
d) any other liability to the extent the same cannot be excluded or limited by law.
12. Force Majeure
12.1 Events beyond our control
12.1.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.
12.1.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes (without limitation) the following:
a) strikes, lockouts or other industrial action.
b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
e) impossibility of the use of public or private telecommunications networks.
f) the acts, decrees, legislation, regulations or restrictions of any government; and
g) pandemic or epidemic.
12.1.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
13. Cancellation of Contract
13.1 Your Rights
13.1.1 You have the right to cancel the sales contract in accordance with this Clause.
13.1.2 You are not obliged to include the reason for cancelling the sales contract but shall ensure that the cancellation shall be made in writing by mail or email or by the return of the items within the fourteen (14) day days of receipt.
13.1.3 Your order cancellation will take place after.
- 13.1.3.1 The product is received by us; and
- 13.1.3.2 Our examination process verifies that the diamond and the precious metal are in their original conditions.
13.1.4 Prior to cancellation you shall retain possession of the item(s) and take reasonable care them.
13.1.5 The Customer bears the direct costs and risks of the returned products.
13.1.6 You are under the duty to take reasonable care to ensure that the returned item(s) are received by us in good condition. We have the right to charge you a refinishing fee for any item(s) returned because of the use or misuse of the items.
13.1.7 A right of cancellation does not exist regarding Bespoke products, Made-to-Order products and Products which are made according to your specifications, which are personalised, or which are not suitable for return due to their nature and/or constitution.
13.1.8 If the right of cancellation is exercised, (s)he is obliged to return the products as soon as reasonably possible but at least within fourteen (14) days of the dissolution at their own expense.
13.1.9 You will be reimbursed for the amount that you are owed within 30 days after we have received the item and once, we have undertaken our quality checks. Please see 14.1.9
14. Returns & Refunds
Our Returns Policy applies to all purchases made on Blacklock Jewellery and are incorporated by reference in these Terms.
14.1 Returns and Exchange Policy – Stock items
14.1.1 If you are not entirely satisfied with your piece of jewellery purchased, you can return within the 'cooling off' period of 14 days. We will exchange the jewellery for an item of the same value, or greater.
14.1.2 Unused pieces of jewellery, with all the original receipts and packaging must be post-marked to us within 14 days of receiving your order for a full refund.
14.1.3 If you wish to return a product to us, either under the rights provided by the Regulations or if you believe the Product is damaged or is the subject of a fault, and you are relying upon your statutory rights and/or you believe that the product is covered by our warranty, you should not make further use of the product. Use of the product can in circumstances outside of the Regulations lead to a reduction in the amount of refund you may be entitled to.
14.1.4 We do not accept returns after 14 days. If, however, you would like a full refund then the following process must be followed.
14.1.5 Please call +44 207 3154284 to inform us that you would like to return your item of jewellery. You will be given a Returns reference number which must accompany item(s) when shipped back to us
14.1.6 Return all original packaging, including any relevant diamond certificates. A replacement fee for a new certificate will be charged if not returned – the cost of which depends on the originating Gemological Laboratory who undertook the original assessment and their fees for replacement. You will be informed accordingly of these fees
14.1.7 Address your package after receiving details from us as to the returns address. Please ensure that there is no mention of Blacklock Jewellery on any outer packaging as this will be a security risk.
14.1.8 Call us before the jewellery is actually sent. Any unauthorised mail will be returned to sender. Any items damaged or altered in any way will not be accepted as returns.
14.1.9 Quality checking/assessment will take place once the item(s) are received.
Once received and checked you will receive an email (quoting your Returns reference number) which will confirm any further course of action if necessary.
14.1.10 We will refund any money received from you, normally by using the same method originally used by you to pay for your purchase.
14.2 Returns and Exchange Policy – Bespoke Orders
